Action of covenant and the said Jacob Phillipson by Evans and Bird his attorneys ________ .

The wrong and injury when _______ and the said article of agreement being read in the words & figures _____________ all men by these presents _____ the said Jacob says that the said plaintiff ought not to have & and maintain his aforesaid action thereof against him because he says that he did furnish the _______ with all the necessary materials for said building whenever they were wanted that he then did find them _______ and their boarding as also the boarding of themselves and their journeymen while they were employed in the building of said ? houstial? he did pay the said plaintiff when the work was done at the rate of seventy five cents for each and every perch measureing one foot high, one foot thick and sixteen feet & half and that he did pay the said Plffes(plaintiffs?) for the painting(pointing?) twelve and a half cents for every yard square and for the chimneys measured agreeable to the coustomary rule of measurement, that he did pay the said Plffs for extra work, for every arch turned over a door and window at the rate of our dollar per foot. That he did keep the said plffs and their journeymen in a constant employ of materials & that he did pay them for the time that they were ?stop? in their work according to the form and effect of the said article of agreement, and of the said Jacob Phillipson by him in that behalf made as aforesaid, to wit at the town of Ste Genevive in the county aforesaid, and of this he puts himself upon the country & Evans & Bird for Plff Traversed ___ ______ _______ To our attorney for ______ and the said Def't for further plea in their behalf according _____ says that the said Plaintiff ought not further __________ ans maintain his aforesaid action thereof against him because he saith that the said Jacob Phillipson on the first day of February in the year eighteen hundred twenty at the town of Ste Genevive in the county aforesaid did pay to the said Michael and Sebastian Butcher the sum of nine hundred dollars all the money that he was bound to pay by the said article of agreement and of this the said Jacob Phillipson puts himself upon the country and the said plaintiff Davis attorney for the ?plt?, Evans & Bird for Def't.

in the foregoing suit. Sir take notice that on the trial of this cause the above named def't will give evidence, and in suit that the above named plffs(plaintiff?) before and at the time of the commencement of this suit was and still is endebted to the said def't in the sum of seven hundred fifty eight dollars seventy two & three forths cents lawful money of the United States for goods, wares, mechandise and money paid to said plffs and at their special insistance & request to their orders and also bonds, bills, notes & receipts of the said plff's given to the said defendants, and that the said def't will sell ______ and allow to the said Plaintiff on the said trial so much of the said sum as will be sufficient to satisfy and discharge such demand awarding to the statute in __________ made _________ _____ Evans & Bird for def't.
