Humbly complaining there with this court your__________ Sebastian Butcher of the County of Ste Genevive that hereto fore to act on the (Blank space) the State of Missouri by his circuit attorney ?commissioned? ?commenced ? ?about? on the common ____________of this court against your orator to foreclose on mortgage _______ your orator to________ to________ the sum of $250. (blankspace) with legal interest at the rate of ?six? per ?antum? from the (blank space) day in the year (blank space) being the ____________ amount of the loan office certificates borrowed by your orator of the loan office at Jackson from said state under and by ________ of an act of the general assembly of the state of Missouri entitled ________ the acts for the establishment of loan office appraised the 27th of June 1821 by which act the state of Missouri was _________ unto five ?districts? in cash of which was established a loan office. The auditor of public accounts & ?treasurer? of said state under the duration of the ?quorum? thereof were ___________ to ?open? certificate signed by the paid?(said?) auditor of the treasurer to the amount of $200 dollars of denomination not exceeding ten and no less than fifty cents..... |

(Page three) Judgement against the borrowers of said certificates & the faith of the state was pledged & constituted a fund for the redemptionof said certificates required by said act to be issued in which ________ commanded against your orator as afore said such procedings were had against your orator at the cost ________ the term of the court that a decree was then and there entered against your orator & the land & ?appastenamus? on said mortgage maintained were ordered to be sold for the payment for the sum on said mortgage mentioned with all interest & costs of ?suit? your orator further saith that said mortgaged premises are _________________ for sale this day and be sold unless permitted by the _________ position of this court.Your orator further saith that ___________ and to making defence by him in said court of this state and demand that the state of Missouri _______ _________by them to the state in consideration of said certificates were ___________ & that the same court be informed that considering said discussion to be the law of the land your orator be advised his councel did not attempt... |
